Strategic Messaging Diagnostic Service Agreement
This Strategic Messaging Diagnostic Participant Agreement (the “Agreement”) is between Creative Self Revolution (“the Company,” “we,” or “us”) and you (“Client” or “you”). By completing your purchase, you irrevocably agree to the following:
1. SERVICES PROVIDED
The Company will provide a Strategic Messaging Diagnostic designed to identify narrative gaps and provide emotional “hooks” for your mission. This includes:
- Pre-session review of up to 3 key organization materials (e.g., website, one email campaign, one donor appeal).
- One (1) 90-minute Deep-Dive strategy session over Zoom.
- A customized Strategic Messaging Diagnostic PDF (delivered within 7 business days of the Deep-Dive).
- One (1) 60-minute follow-up session over Zoom to be held within 14 days of delivery of the diagnostic.
2. NATURE OF THE RELATIONSHIP
You acknowledge that while we provide strategic tools and “hooks,” your success depends on your implementation, external market factors, and organizational commitment. We do not guarantee specific levels of donations, grants, or engagement. The Diagnostic is an investment in your organizational clarity; as with any investment, there is both potential for return and a risk of low return.
3. CONFIDENTIALITY AND NON-DISCLOSURE
- Our Proprietary System: You acknowledge that our methods, frameworks, and diagnostic templates are our confidential property and protected by copyright. You agree not to duplicate, distribute, or disclose our proprietary methods to 3rd parties.
- Your Information: We consider your future plans, donor lists, and internal affairs to be your proprietary information. We promise that all information provided during this diagnostic will be kept strictly confidential.
4. RECORDINGS OF SESSIONS
You acknowledge and agree that the Company may record the 90-minute Deep-Dive session for internal research and synthesis purposes only. These recordings are used to ensure the accuracy and depth of the final Diagnostic PDF. The Company will not use the recordings for any other use outside the strategy sessions.
5. OWNERSHIP OF PROPERTY
The final Diagnostic PDF is your property for internal use. However, the underlying frameworks and “Proprietary System” remain the property of the Company. You shall not attempt to replicate or sell our strategy process for your own competitive benefit.
6. RESCHEDULING & MATERIALS
Both parties agree to provide at least 24 hours’ notice for rescheduling. You agree to provide your 3 review materials at least 48 hours before the Deep-Dive session. Failure to provide materials may result in a rescheduled call.
7. PAYMENT & REFUND POLICY
Client agrees to pay the service fee in full at the time of booking. All payments are non-refundable once the 90-minute Deep-Dive session has commenced.
8. LIMITATION OF LIABILITY
Under no circumstances will either party be liable to the other for any amount greater than the Fees paid. Neither party will be liable for indirect or consequential damages.
9. ARBITRATION & JURISDICTION
Any controversy or claim arising out of this Agreement, or the breach thereof, or in any way relating to the Offer, which the parties hereto are unable to resolve after at least thirty (30) days of good faith negotiations, shall be settled by binding arbitration in accordance with the commercial rules of the American Arbitration Association and the location shall be in the County of Riverside, California, before a single arbitrator. You agree to California jurisdiction. The losing party is responsible for all costs of collection, including attorney’s fees.
10. ENTIRE AGREEMENT
This Agreement sets forth the entire agreement of the parties and replaces all prior oral or written agreements.
